1. Acceptance of Terms

We may modify, suspend, or discontinue any aspect of the Service at any time, including features, hours of availability, and equipment needed for access.
4. User Accounts and Roles
E-school Academy provides different types of user accounts with varying levels of access:
Account Types:
- School Administrators: Full system access and management capabilities
- Teachers/Staff: Access to classroom management, grade entry, and student information
- Students: Access to their academic information, assignments, and communication tools
- Parents/Guardians: Access to their children's academic progress and school communications
- Super Administrators: System-wide management and technical support access
When creating an account or having an account created for you, you agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate and current
- Maintain the security and confidentiality of your login credentials
- Use your account only for its intended educational purposes
- Accept responsibility for all activities under your account
- Notify your school administrator immediately of any unauthorized use
Schools are responsible for managing user accounts within their institution and ensuring appropriate access levels for each user type.
5. Acceptable Use Policy
You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

- Use the Service only for legitimate educational purposes
- Respect the academic integrity policies of your institution
- Maintain appropriate professional or student conduct in all interactions
- Protect the privacy and confidentiality of student information (FERPA compliance)
- Report any security vulnerabilities or data breaches immediately
- Comply with your institution's acceptable use policies
- Use appropriate language and behavior in all communications
Prohibited Activities:
- Violate any applicable laws, regulations, or third-party rights
- Impersonate any person or entity or misrepresent your role or affiliation
- Share login credentials with unauthorized persons
- Access or attempt to access accounts or data you're not authorized to view
- Submit false academic information or facilitate academic dishonesty
- Engage in harassment, bullying, or discrimination of any kind
- Post or transmit spam, unsolicited communications, or non-educational content
- Upload or distribute malware, viruses, or other harmful code
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the Service or servers/networks connected to the Service
- Use automated systems (bots, scrapers) to access the Service without permission
- Collect or harvest personal information about other users beyond what's necessary for educational purposes
- Use the Service for commercial purposes unrelated to education
- Violate student privacy rights or share confidential student information inappropriately
Educational Content Restrictions:
You may not post, upload, or share content that:
- Is illegal, harmful, threatening, abusive, or offensive
- Violates intellectual property rights or academic integrity policies
- Contains false or misleading information that could harm educational outcomes
- Is sexually explicit, contains nudity, or is otherwise inappropriate for an educational environment
- Promotes violence, discrimination, bullying, or illegal activities
- Violates privacy rights of students, parents, or staff members
- Contains personal information about minors without proper authorization
- Includes copyrighted educational materials without proper licensing
- Facilitates cheating, plagiarism, or other forms of academic dishonesty

6. Educational Content and Student Records
Student Educational Records:
E-school Academy handles student educational records in compliance with the Family Educational Rights and Privacy Act (FERPA) and other applicable privacy laws. Educational records include grades, attendance, disciplinary records, and other personally identifiable information from education records.
Your Content:
You retain ownership of educational content you create and post on our Service ("User Content"), including assignments, projects, discussions, and other academic work. Institutional Rights:

The E-school Academy platform and its original content, features, and functionality are owned by E-School Academy and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our written permission.
7. Privacy and Educational Data Protection
Protecting student privacy and educational data is our top priority. Service Suspension:

11. Suspension and Termination
We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include:

- Fraudulent, abusive, or illegal activity
- Extended periods of inactivity
- Technical or security reasons
You may terminate your account at any time by contacting us or using account deletion features in our Service. Upon termination, your right to use the Service ceases immediately.
12. Disclaimers and Warranties

- ANY DAMAGES RESULTING FROM YOUR USE OF THE SERVICE
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.
14. Indemnification
You agree to defend, indemnify, and hold harmless E-School Academy, its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

- Your violation of these Terms
- Your violation of any third-party rights

15. Dispute Resolution
Governing Law:
These Terms shall be governed by and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions.
Arbitration Agreement:
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration in accordance with the Arbitration and Conciliation Act of Nigeria. The arbitration shall be conducted in Nigeria, and judgment on the arbitration award may be entered into any court having jurisdiction thereof.

Either party may seek injunctive relief in court for intellectual property infringement or violation of confidentiality obligations.
Class Action Waiver:
You agree that any arbitration or legal proceeding shall be limited to the dispute between us and you individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemic, government actions, natural disasters, or technical failures.
